Mayflower Villa hereafter referred to as 'The Owner'
Booking
Please ensure you read and understand the following terms and conditions for your accommodation rental. If you have any queries, please contact us for clarification before you sign the booking confirmation form. This document is designed for information, and to protect the interests of both parties. We hope you enjoy your holiday.
Whilst we reserve the right to increase or decrease accommodation prices at any time, we will confirm to you the current price at the time of booking. As soon as you have confirmed your booking and paid your deposit or full payment, the cost of the rental is guaranteed against any further increase. This guarantee is offered subject to our terms and conditions, payment being adhered to and providing you do not make further amendments to your holiday arrangements.
Whilst we try to keep the photos on the website up to date we reserve the right to alter any soft furnishings or furnishings within the property, such as bedding, etc.
Your holiday home rental covers accommodation as booked, including local sales/tourist taxes and services e.g. gas, water, cable TV, local telephone calls and electricity (pool heating is priced separately). NOT included in our rental prices: Flights, Car Hire, Holiday Insurance, and Pool Heating (this can be booked in advance for an extra fee).
The completion of the booking form confirms acceptance of the terms and conditions set out below and shall be binding on the persons intending to occupy the premises whether or not such persons have signed the booking form. Everyone staying in the villa must be listed on the booking form. This is Florida state law and must be adhered to.
Reservation Deposit and Payment of Balance
The reservation deposit of £200/$200 is payable with the completed booking form. The full balance to be paid at least 10 weeks before departure. If the balance remains unpaid within 9 weeks of departure, we reserve the right to cancel your booking.
Security Deposit
In addition to the rental charge, a security deposit of £100/$200 is payable to cover breakage or damage to the premises and/or contents, excessive electricity costs caused by leaving external doors open with the air conditioning on, and excessive cleaning costs, other than those normally incurred in connection with the occupation of the premises. This deposit is refundable as soon as it is confirmed that the property has been left in a satisfactory condition, within a time limit not exceeding 3 weeks following date of return.
Cancellations
In the unlikely event that circumstances beyond the Owner's control, necessitate the Owner's cancellation of the rental arrangement, the Owner reserves the right to cancel any bookings at any time and will only be liable to refund monies already paid by the Guest. The owner will endeavour to find the guest alternative accommodation via local contacts but cannot guarantee that alternative arrangements will be exactly the same, or that any can be found for the dates required.
- If the balance of the sum due as shown on the booking form remains unpaid 6 weeks prior to the date of departure we reserve the right to cancel the booking and, in this event, the deposit will be forfeit.
- If you cancel after the booking is confirmed, the deposit will be forfeit.
- If you cancel within 6 weeks of the date of departure the full rental will be due and forfeit. Owner will try to re-let and if successful will refund an amount to the Guest at the owner's discretion.
- The person who signed the booking form or his/her representative must confirm all cancellations by telephone and confirm in writing.
Obligations
To take good care of the property and contents and leave it in a clean and tidy condition at the end of the holiday. The barbeque is for your enjoyment but if it is not left clean then a cleaning fee of $50 will be deducted from your security deposit.
Documentation
All passports, visas and health certificate requirements are the client's responsibility. At the present time travellers to the United States must hold a full 10-year passport, valid for 6 months beyond return date, at the time of departure. It is your responsibility to ensure that all documentation confirms to current requirements and regulations for travel to the USA. The Company cannot accept responsibility for any delay or expense incurred through any irregularity in such documents.
Insurance
TRAVEL AND CANCELLATION INSURANCE IS STRONGLY ADVISED. If proof of payment is necessary The Owner will gladly provide the required information in support of your claim.
Owners Access
The owners or their management company shall be allowed access at any reasonable time during your stay.
Parents must supervise children at all times
particularly in the pool area, and when accessing the villa via an uncarpeted area. No responsibility/liability will be accepted for any accident, injury or damage sustained during tenancy, regardless of howsoever it may have occurred.
Arrival and Departure
This will be after 4pm by combination lock located near the front door of the villa. You will receive the lock code and address along with driving instructions with your final documents. The villa will be available for occupancy from 4.00pm on the date of arrival and must be vacated by 11.00am (prompt) on the day of departure.
During your Stay
Whenever you leave the property, you are responsible for ensuring its security by closing and locking all windows and doors.
Parents must supervise children at all times particularly in the pool area, and when accessing the villa via an uncarpeted area. No responsibility/liability will be accepted for any accident, injury or damage sustained during tenancy, regardless of howsoever it may have occurred.
Breakage and Damage
It is the guest's responsibility to read and comply with the 'guest information book' located in the home. The villa will be checked immediately after departure of guests. Should any breakage or damage occur during your stay you must notify the Management Company before leaving the USA. Should the cost of repair or replacement be your responsibility you will be held responsible for all additional costs that exceed the security deposit. The Management Company will, if necessary, advise both you and The Owner accordingly.
Pool
The pool and spa can be heated if required for an additional fee to be paid with the final payment. A pool cover is supplied, please cover the pool every night. This will ensure the pool heat works efficiently. Do not allow anyone to walk on the cover. It will not bear weight and can wrap around the person making it very hard to get out of the pool. Glassware on the poolside is strictly prohibited. It is an unseen danger to you and others. Pool rules on display at the poolside must be strictly obeyed.
The property has a private swimming pool that is gas heated at an additional fee. Pool heat commences at the time it is switched on, meaning that is your first day. It will take at least 24 hours to heat the pool. If clients wish to swim immediately upon their arrival, then it is recommended they pay extra for it to be switched on one day before they arrive. If the air temperature drops below 50 to 55 degrees, then the heater may not heat the water sufficiently. This is an ‘act of nature’ and we cannot be held responsible for the pool not heating to your satisfaction. Therefore no refund will be given. Clients may use the swimming pool at their own risk.
The pool is cleaned, inspected and chemically balanced for your safety and comfort; however on occasions it may be necessary to apply extra chemicals to the pool to maintain safe and correct chemical levels. Should this occur during your stay it will be necessary for you to be out of the pool for a period of 12-24 hours for safety reasons.
The water in the swimming pool is chlorinated for your benefit but will stain and bleach fabrics. Before entering the Villa from the pool area please ensure that all guests and particularly children have dried off as much as possible. Wet clothes and towels must not be placed on floors or furnishings, a clothes airier is provided.
Wireless Internet
Wireless Broadband Internet connection is provided for guests use. Please note that this service is provided FREE to guests. The owners will use their best endeavors to ensure that the service is available for use, but cannot be held responsible for any failures, or non-availability, of communication lines, hardware or software.
Smoking and Pets
If you smoke we ask that you restrict this to the outside deck and refrain from smoking in the villa. We reserve the right to deduct from the security deposit any extra cost, such as deodorising and/or extraordinary cleaning due to smoking in the villa. We do not allow any pets in our villa.
Complaints
We hope you have a great time in Florida and don't have any cause for complaint but if you do have any complaints relating to the accommodation they must be made in to the local Management Company within 24 hours of any problem arising, verbally and then by letter (the address and telephone number will be located in the villa). It is your responsibility to ensure that the Management Company informs The Company of the complaint, either by telephone or facsimile message at that time. If this procedure is not followed claims will not be considered. Failure to do so will be regarded as a breach of contract between you and The Company.
Regulations
The maximum number of occupancy is 12 persons for the villa, plus a baby sleeping in a cot, and is determined by the authorities with strict guidelines for fire safety. Contravention of the above will render your booking void, and you will be asked to leave the villa immediately with no compensation.
Liability
Please do not leave the dishwasher, washing machine or tumble dryer unattended. No responsibility will be taken by the company for any damage caused from use of these machines.
Force Majeure
We cannot, and do not, accept responsibility for any cancellation, alteration or amendment to your booking brought about by way, riot, civil strife, industrial dispute, natural and nuclear disaster, fire, adverse weather conditions, technical problems, closure or congestion of airports, cancellations or changes of schedules by airlines and similar events beyond our control.
Orange Tree is a residential community. The actions of all members of your party should not interfere with the enjoyment of either other holidaymakers or the residents of Orange Tree. Please do not use the swimming pool, play loud music or engage in any activity which may cause inconvenience to your neighbours after 11pm or before 07.30am. In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other holidaymakers, residents of Orange Tree or damage to any property, the owners or their management company reserve the right to terminate your rental agreement immediately and forthwith. The owners or their management company will not be liable for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action. Bad behaviour is taken seriously in Florida.
The villa is located in Florida, which contains a variety of wildlife, which you may or may not see during your stay. Some of Florida’s inhabitants (alligators and snakes amongst them) can be dangerous and extreme caution must be taken at all times. Walking around wet areas can be particularly hazardous especially when the ground is not clear i.e. long grass, and swimming in lakes, rivers and ponds is strictly forbidden. Take sensible precautions at all times wherever you are and do not allow children to play unsupervised.
The feeding of any wildlife is against the law in Florida and strict penalties will be applied to anyone found breaking this law.
